Subsequently, the Magistrate Judge agreed to reconsider the matter 48 , and both parties have now briefed the issue 45 and 49 . Having reconsidered the matter, the Magistrate Judge again declines to reopen discovery. In view of these proceedings the Plaintiffs' deadline for responding to the pending mo tion for summary judgment 39 is canceled. The Magistrate Judge will issue new deadlines for further proceedings following consideration of the Defendants response and the Plaintiffs motion for reconsideration.
