Pursuant to 28 U.S.C. § 636(b(1), Fed. R. Civ. P. 72(b)(3) and Local Rule 72.03(b)(3), the Court has reviewed de novo the Report and Recommendation, the Objections, and the file. The Objections of the Plaintiff are overruled, and the Report and Recommendation is adopted and approved. Accordingly, judgment is entered for Plaintiff against Defendants James Brooks, Avie Cohen, Claude Halcomb, David Galt and Judy Halcomb, jointly and severally, in the total amount of $29,928.00. The jury trial set for December 13, 2011, and the pretrial conference set for December 5, 2011, are canceled. The Report and Recommendation is adopted and approved. Accordingly, Plaintiff's Motion for Default Judgment ag ainst Defendant Brooks 106 , Motion for Default Judgment against Defendant Cohen 107 and Motion for Default Judgment against Defendant Claude Halcomb 114 are GRANTED in part, as to liability, and TAKEN UNDER ADVISEMENT in part as to the amount o f damages. This matter is returned to the Magistrate Judge for a Report and Recommendation on the appropriate amount of damages. By March 14, 2011, the parties shall submit an Agreed Order of Dismissal regarding this settlement or otherwise advise t he Court in writing as to the status of the settlement. This case is set for a jury trial on May 3, 2011, and a pretrial conference on April 18, 2011, at 1:00 p.m. 129 .
