December 9, 2010 Opinion or Order Filing 25 ORDER: Motion to Compel 22 is Denied. The record indicates that on 12/7/2010, after plaintiff returned the completed summons and U.S. Marshal's 285 form, the Clerk has issued process to defendant Covenant Transport 23 . Therefore, to the ext ent that plaintiff's motion seeks the issuance and service of process on the defendant, her motion is DENIED as moot. The Court finds that plaintiff's motion seeking an order requiring alternate dispute resolution to be, at best, premature. Therefore, the Court DENIES plaintiff's motion to the extent it seeks an order requiring ADR without prejudice to the plaintiff's right to seek such relief later after the defendant has been served with process and has entered an appearance in the case. Signed by Magistrate Judge John S. Bryant on 12/9/10. (xc:Pro se party by regular and certified mail.)(dt)
November 18, 2010 Opinion or Order Filing 20 ORDER: The Clerk is directed to mail to plaintiff a second service packet for defendant Covenant Transport. Plaintiff shall complete these forms and return them to the Clerk on or before 12/3/2010. Upon receipt of completed service forms from the pla intiff, service on defendant Covenant Transport shall be accomplished through the U.S. Marshals service. Plaintiff is admonished that if she fails to return the completed service packet as ordered, her failure may cause the undersigned Magistrate Judge to recommend that the complaint be dismissed pursuant to Federal Rule 4(m) for failure to obtain service on the defendant. Signed by Magistrate Judge John S. Bryant on 11/18/10. (xc:Pro se party by regular and certified mail.)(dt)
December 1, 2009 Opinion or Order Filing 14 ORDER: The plaintiff's objections 13 are OVERRULED, and the Report and Recommendation 7 is ACCEPTED and made the findings of fact and conclusions of law of this court. November 12, 2009 Opinion or Order Filing 7 REPORT AND RECOMMENDATION that this case be allowed to proceed, and that service of process should issue, against defendant Covenant Transport only. For the reasons stated in this Report and Recommendation, the undersigned Magistrate Judge RECOMMENDS that the complaint should be DISMISSED as frivolous against the Equal Employment Opportunity Commission and Volunteer Training Center Trucking School. Signed by Magistrate Judge John S. Bryant on 11/12/09. (cc: Pltf by reg and cert mail)(km)
