Filing 57 ORDER: For the foregoing reasons, the Court finds that Plaintiffs have not produced sufficient evidence to create a genuine dispute of material fact regarding either their breach of contract or unjust enrichment claims. Filing 52 ORDER: Defts' 24 Motion to Strike the 19 Declaration of William Q. Acree is GRANTED. The Court finds that pltfs have not alleged sufficient facts to state a claim as to: (1) their breach of contract claim against RSI; (2) their unjust enrich ment/quantum meruit claims against RST; (3) their claims under the TCPA; (4) their claims under the TTPA; (5) their claims under the UTSA; and (6) their claims of unfair competition and intentional interference with prospective business advantage. Defts 13 Motion to Dismiss is therefore GRANTED in part, as to those claims, and DENIED in part, as to pltfs claims for breach of contract by RST and for unjust enrichment as to RSI.
