ORDER: Pltf's 9 application to proceed in forma pauperis is GRANTED. Pltf is herewith ASSESSED the $350 civil filing fee to be paid from his inmate's trust fund account. In accordance with the Memorandum contemporaneously entered,the complaint fails to state a claim upon which relief can be granted. Consequently, this action is hereby DISMISSED without prejudice.
