Filing 190 ORDER: Pending before the Court is a Report and Recommendation of the Magistrate Judge (Docket No. 189 ), to which no Objections have been filed. The Court has reviewed the Report and Recommendation and the file. The Report and Recommendation is a dopted and approved. Accordingly, the Motions for Summary Judgment filed by the Defendants (Docket Nos. 177 , 178 , 181 , 186 ) are GRANTED, and this action is DISMISSED. The Clerk is directed to close the file. The pretrial conference set for July 21, 2014, and the jury trial set for July 29, 2014, are canceled. This Order shall constitute the final judgment in this case pursuant to Fed. R. Civ. P. 58. The proposed amended complaint is DENIED. In view of this ruling to deny the proposed amended complaint, the motion to strike 69 is terminated as MOOT. The Clerk is directed to advise the Plaintiff of the cost of copying the new proposed amended complaint, and the Clerk shall send Plaintiff a copy upon payment of that amount.
