MEMORANDUM OF THE COURT: Pending before the Court is Defendant's Motion for Summary Judgment (Docket No. 23 ). For the reasons stated herein, Defendant's Motion is GRANTED, and this action is DISMISSED. In light of Plaintiffs' inabi lity to show a genuine issue of material fact with regard to these two elements of their Title VI claim, the Court need not address Defendant's other arguments.
