Count Three of the plaintiffs' First Amended Complaint, which purports to assert an independent claim for civil rights intimidation under 39-17-309, is DISMISSED WITH PREJUDICE with respect to all defendants. The plaintiffs' claims for assault and battery (Count Four), outrageous conduct (Count Five), and negligence/gross negligence (Count Six), are DISMISSED WITH PREJUDICE as to Metro Nashville only. The defendants' arguments for dismissing the plaintiffs' remaining claims are DENIED AS MOOT, without prejudice to re-asserting those grounds for dismissal after the plaintiffs file a Second Amended Complaint in compliance herewith. The Motions for a More Definite Statement (Docket Nos. #28 , #31 , and #34 ) are GRANTED. The plaintiffs' Second Amended Complaint, to be filed in compliance with this Order, shall allege facts specific to each named defendant officer to support the plaintiffs' claims against each individual officer. The plaintiffs' Motion for Leave to Amend First Amended Complaint (Docket No. #47 ) is GRANTED IN PART and DENIED IN PART. By May 4, 2013, the plaintiffs shall file a Second Amended Complaint consistent with this Order and with the guidelines set forth in the accompanying Memorandum.
