May 16, 2014 Opinion or Order Filing 69 ORDER ADOPTING REPORT AND RECOMMENDATION: On April 4, 2014, the Magistrate Judge issued a "Certification of Facts Regarding Contempt/Report & Recommendation" (Docket No. 66 ), to which no objections have been filed. The Report and Recomm endation is, therefore, ACCEPTED and made the findings of fact and conclusions of law of this court. For the reasons expressed therein, it is hereby ORDERED that the defendant is found in civil contempt, and the court hereby imposes a fine in the amount of $50 per day for a 30-day period or for a shorter time, if the defendant purges his contempt. The fine is to be paid into the Registry of this court. The Clerk shall mail a copy of this Order to the pro se defendant at his present address, by certified mail, return receipt requested. April 4, 2014 Opinion or Order Filing 66 REPORT AND RECOMMENDATION: Magistrate Judge Knowles recommends that Defendant be held in civil contempt. He has failed to comply with the following orders of the Court: (1) Order entered July 18, 2013 32 granting Plaintiff's Motion to Compel; and (2) Order entered October 1, 2013 47 requiring Defendant to pay Plaintiff's reasonable attorneys fees and expenses in the amount of $1,767. Additionally, Defendant failed to respond to two Motions for Orders to Show Cause 36 , 53 and he failed to attend two Show Cause Hearings, on September 12, 2013, and February 19, 2014. He also failed to respond to Plaintiff's "Request for Sanctions for Civil Contempt" 60 . The undersigned further recommends that a civil fi ne be imposed upon Defendantbeginning 10 days following the entry of the Court's Order finding Defendant in contempt, in the amount of $150 per day for a 30 day period.
