The file is hereby forwarded to the Clerk of Court for his consideration of the motion for default judgment pursuant to Rule 55(b)(1) of the Federal Rules of Civil Procedure. Since it appears that the defendant was properly served with the complaint through the Hague Convention in January of 2014, see Docket Entry No. 16, no response to the complaint or other filings have been made by the defendant nor has the defendant communicated in any manner with the Court, and default has been entered pursuant to Rule 55(a) of the Federal Rules of Civil Procedure by the Clerk, see Docket Entry No. 19, it appears that the defendant has no intention of entering an appearance in this case or otherwise defending this action. Therefore, unless otherwise directed by the Court or upon motion of the parties, there will be no further proceedings before the Magistrate Judge in this case. It is so ORDERED. April 2, 2014 Opinion or Order Filing 17 ORDER: Counsel for the plaintiff appeared at the scheduled initial case management conference on April 1, 2014, but no appearance was made on behalf of the defendant. The defendant has not responded to the complaint or otherwise entered any appearance in this case. Plaintiff's counsel advised that the defendant had been served with process pursuant to the Hague Convention in January of 2014, and that confirmation of service had been forwarded to the Clerk on January 21, 2014. Since the return of service had not been docketed, it appeared that the Clerk had not been able to match the return to this lawsuit, but the Clerk was able to retrieve the return and docket it on April 1, 2014. See Docket Entry No. 16. Plaintiff's counsel advised that he intended to file a motion for entry of default in accord with Rule 55(a) of the Federal Rules of Civil Procedure.
