Although Plaintiff seeks dismissal under Federal Rule of Civil Procedure 41 (a)(l )(A)(ii), the Notice is not signed by Defendant Fifth Third Bank as required by the Rule. However, as Defendant has not served either an answer or motion for summary judgment, dismissal is appropriate under Rule 41 (a)(l)(A)(i). Accordingly, the case is DISMISSED without prejudice.
