Filing 183 MEMORANDUM OPINION AND ORDER: As discussed above, the second motion to amend the answer (encompassed within the Motion for Relief) is not cognizable because it was unjustifiedly filed too late. This is fatal to the entire Motion for Relief. Accord ingly, the Motion for Relief (Doc. No. 180 ) will be DENIED. This leaves nothing for the Court to do to "conclude this story," in the words of the Sixth Circuit, other than to enter judgment, which the Court intends to do in the same amo unts reflected in the prior judgment in this case (Doc. No. 132 ) it had entered prior to the last appeal to the Sixth Circuit, except possibly with an increase in the amount for prejudgment interest based on the lapse of time between the origina l judgment (March 3, 2021) and the present day. By June 1, 2023, the parties shall submit either separate proposals or a joint proposal for the figure for prejudgment interest to include in the anticipated judgment. An appropriate judgment thereafter will be entered. Signed by District Judge Eli J. Richardson on 5/22/2023. (DOCKET TEXT SUMMARY ONLY-ATTORNEYS MUST OPEN THE PDF AND READ THE ORDER.)(ln) |
Filing 122 MEMORANDUM AND FINDINGS OF FACT AND CONCLUSIONS OF LAW PURSUANT TO FED. R. CIV. P. 52. Signed by District Judge Eli J. Richardson on 01/13/2021. (DOCKET TEXT SUMMARY ONLY-ATTORNEYS MUST OPEN THE PDF AND READ THE ORDER.)(ln) |
Filing 120 MEMORANDUM OPINION AND ORDER: Given the Court's conclusion that the Non- Solicitation Clause is unenforceable and that Defendant has lost its prerogative to assert other causes to justify Plaintiff's termination, and the parties' mut ual assertions that the essential facts are not in dispute, there is no need to effectively reopen the bench trial for additional testimony. The Court will instead proceed directly issuing findings of facts and conclusions of law as soon as feasible. Signed by District Judge Eli J. Richardson on 1/8/2021. (DOCKET TEXT SUMMARY ONLY-ATTORNEYS MUST OPEN THE PDF AND READ THE ORDER.)(am) |
Filing 113 MEMORANDUM OPINION AND ORDER: Accordingly, by October 23, counsel for the parties shall: (a) confer with one another about the issues that remain to be decided, when they should be decided, and how they should be decided; and (b) file a joint noti ce to the Court setting forth any mutually agreed recommendations they have on these issues and, to the extent they do not mutually agree, their respective differing views. Signed by District Judge Eli J. Richardson on 10/13/2020. (DOCKET TEXT SUMMARY ONLY-ATTORNEYS MUST OPEN THE PDF AND READ THE ORDER.)(am) |
Filing 48 MEMORANDUM OPINION OF THE COURT. Signed by District Judge William L. Campbell, Jr on 8/3/18. (DOCKET TEXT SUMMARY ONLY-ATTORNEYS MUST OPEN THE PDF AND READ THE ORDER.)(af) |
