Having conducted a de novo review of those portions of the R&R to which the defendants have properly objected, th e court finds the Objection to be without merit. The Objection (Doc. No. 64) is OVERRULED, and the court ACCEPTS the magistrate judge's findings and recommendations in their entirety. The defendant's Motion for Summary Judgment (Doc. No. 49) is DENIED. The case is returned to the magistrate judge under the original referral Order for consideration of the plaintiff's pending Motion for Appointment of Counsel (Doc. No. 58).
