No. 10) is GRANTED, provided, howev er, that (a) within fourteen (14) days or receipt of this Memorandum Opinion and Order, he FILES an Amended Complaint that names Sonic as a Defendant and states a plausible claim against that Defendant as required by Rule 8 of the Federal Rules of Civil Procedure; and, (2) within forty-five (45) days of this Memorandum Opinion and Order, he effectuates proper service in accordance with Rule 4 of the Federal Rules of Civil Procedure on that Defendant.
