ORDER AND MEMORANDUM OPINION: Pending before the Court is Defendant Matthew Hopkins' ("Defendant") Motion to Dismiss for Lack of Subject Matter Jurisdiction (Doc. No. 10 ). Plaintiffs filed a response and surreply (Doc. Nos. [12 ], 22 ) and Defendant replied. (Doc. No. 28 ). The Court also requested the parties to conduct limited discovery and both parties provided supplemental briefs. (Doc. No. 40 , 42 ).
