Filing 34 ORDER: On January 28, 2020, the magistrate judge issued a Report and Recommendation (Docket No. 32 ), to which no timely objections have been filed. Therefore, the Report and Recommendation is ACCEPTED and made the findings of fact and conclusion s of law of this court. For the reasons expressed therein, the following are hereby ORDERED: 1. The plaintiff's claims under 42 U.S.C. § 1983 are DISMISSED WITHOUT PREJUDICE for failure to prosecute; 2. The remaining state law claims are DISMISSED WITHOUT PREJUDICE; and 3. The defendants' Motion for Summary Judgment (Docket No. 16 ) is DENIED AS MOOT. This Order constitutes the judgment in this case. Signed by District Judge Aleta A. Trauger on 2/13/2020.
