MEMORANDUM AND ORDER: Billy Dean Woodard's IFP application (Doc. No. #2 ) is GRANTED, and the filing fee of $350.00 is assessed in accordance with this order. Because the plaintiff's complaint seeks relief that is only available through a petition for the writ of habeas corpus, or that is not yet cognizable under 1983, it is DISMISSED pursuant to 28 U.S.C. 1915(e)(2) and 1915A for failure to state a claim upon which relief can be granted. This dismissal is without prejudice to the plaintiff's right to pursue appropriate habeas remedies. Finally, the plaintiff's motion to appoint counsel (Doc. No. #3 ) is DENIED as moot.
