Filing 4 ORDER: Plaintiffs Latonya Waddell, Michael Reeves, and Spencer Reeves, Jr. bring this action under 42 U.S.C. 1983 and state law based on allegations that their father, Spencer Reeves (Senior), now deceased, was denied necessary medical care while incarcerated at the Lois M. DeBerry Special Needs Facility, operated by the Tennessee Department of Correction. Plaintiffs have paid in full the $400 filing fee. By statute, the State of Tennessee has expressly preserved its sovereign immunity. Tenn. Code Ann. 20-13-102. The claims against the State of Tennessee and the Department of Correction are therefore DISMISSED WITHOUT PREJUDICE based on sovereign immunity. However, the court finds that the remaining claims against the remaining defendants are not subject to dismissal at this juncture. This case, minus the claims against the state and the state agency, is REFERRED to the magistrate judge. The plaintiffs are notified that they are responsible for effecting service of process on the defendants in accordance with the Federal Rules of Civil Procedure. Signed by District Judge Aleta A.
