Proc. 15(a)(1)(B), they did not, so permission of the court is required under Rule 15(a)(2) and should be freely given in the interests of justice. If the amendment would be futile, as the defendant argues (DE 43), it may be denied. The defendant argues the amendment would not cure the defects they contend doom the pending complaint. However, in order to determine if that is correct, the court would have to decide the motions to dismiss. It would be better to allow the amendment and for the defendant to refile their motions to dismiss so there can be one decision by the District Judge that resolves the issues. The plaintiffs have had their second bite at the apple with the second amended complaint. Any further attempt to amend would likely be denied. It is relatively early in the case and the proposed amendment is well within the time allowed for a motion to amend. In view of the amended complaint, the Clerk will terminate the motions to dismiss without prejudice to the defendant refiling them in response to the amended complaint. While the Plaintiff could have filed the amended complaint within 21 days of the motions to dismiss (DE 23, 28) without leave of court under F.R. Cv. Proc. 15(a)(1)(B), they did not, so permission of the court is required under Rule 15(a)(2) and should be freely given in the interests of justice. If the amendment would be futile, as the defendant argues (DE 43), it may be denied. The defendant argues the amendment would not cure the defects they contend doom the pending complaint. However, in order to determine if that is correct, the court would have to decide the motions to dismiss. It would be better to allow the amendment and for the defendant to refile their motions to dismiss so there can be one decision by the District Judge that resolves the issues. The plaintiffs have had their second bite at the apple with the second amended complaint. Any further attempt to amend would likely be denied. It is relatively early in the case and the proposed amendment is well within the time allowed for a motion to amend. In view of the amended complaint, the Clerk will terminate the motions to dismiss without prejudice to the defendant refiling them in response to the amended complaint.
