Filing 11 ORDER: Presently pending is Plaintiff's motion for leave to file an amended complaint (Docket Entry No. 9 ). Although filed as a motion for leave to amend, what Plaintiff actually seeks is to sever his two claims so that they would proceed as separate cases. Defendants have not opposed the motion. Plaintiff's motion is GRANTED. The Clerk's Office shall terminate James Walker and Brandon Smith as defendants in the instant case and shall strike docket entry No. 13 from the docket in the instant action. The Clerk's Office is directed to open a new case styled as Justin Ezra Jones v. James Walker and Brandon Smith, which will consist of only Plaintiff's Eighth Amendment claims against these two defendants. The Clerk's Office shall copy and file as docket entries in the new case the following filings in the instant case: docket entry nos. 1, 2, 3, 4, 5, 6, 7, 8, 9, and 13. Filing 7 ORDER: Justin Jones, an inmate of the Robertson County Detention Facility in Springfield, Tennessee, has filed a pro se complaint for alleged violation of his civil rights pursuant to 42 U.S.C. 1983. (Doc. No. 1.) This matter is before the Court on Plaintiff's application to proceed in forma pauperis (IFP), which he has supplemented by filing his six-month trust account summary. (Doc. Nos. 2, 5.) Because it appears from Plaintiff's submissions that he lacks sufficient financial resources from which to pay the full filing fee in advance, his application to proceed IFP (Doc. No. 2 ) is GRANTED. However, under 1915(b), Plaintiff nonetheless remains responsible for paying the full filing fee. Accordingly, Plaintiff is hereby ASSESSED a $350 filing fee. The Clerk of Court is DIRECTED to send a copy of this Order to the Administrator of the Robertson County Detention Facility to ensure that the custodian of Plaintiff's inmate trust account complies with the portion of 28 U.S.C. 1915 pertaining to payment of the filing fee. For the reasons stated in the accompanying Memorandum Opinion 6, the Court finds that Plaintiff has not stated a claim for which relief can be granted against Southern Health Partners, and Southern Health Partners is DISMISSED from this action. Accordingly, The Clerk is INSTRUCTED to send Plaintiff service packets (a blank summons and USM 285 form) for the remaining Defendants. Upon return of the completed service packets, PROCESS SHALL ISSUE. This action is REFERRED to the Magistrate Judge to enter a scheduling order for the management of the case, to dispose or recommend disposition of any pretrial motions under 28 U.S.C. 636(b)(1)(A) and (B), including Plaintiff's pending motion for injunctive relief (Doc. No. 4 ), and to conduct further proceedings, if necessary, under Rule 72(b) of the Federal Rules of Civil Procedure and the Local Rules of Court. Signed by Chief Judge Waverly D.
