ORDER: Plaintiff Gerald A. Sanford, Sr., an inmate at Hardeman County Correctional Facility in Whiteville, Tennessee, filed a pro se civil rights complaint under 42 U.S.C. 1983 (Doc. No. #1 ) and an application to proceed in this Court without prepaying fees and costs (Doc. No. #2 ). It appears from Plaintiff's submitted materials that he cannot pay the full filing fee in advance. Accordingly, Plaintiff's application (Doc. No. #2 ) is GRANTED, and he is ASSESSED the $350.00 filing fee. The Clerk is DIRECTED to send a copy of this Order to the Hardeman County Correctional Facility in Whiteville, Tennessee, to ensure that the custodian of Plaintiff's inmate trust account complies with the portion of 28 U.S.C. 1915 pertaining to payment of the filing fee. Here, the most appropriate venue for this action is the Western District of Tennessee. The allegations that form the basis of this action occurred at Hardeman County Correctional Facility, and Hardeman County is in the Eastern Division of the Western District of Tennessee. Accordingly, the Clerk is directed to TRANSFER this action to the United States District Court of the Western District of Tennessee, Eastern Division at Jackson, Tennessee. 28 U.S.C. 1406(a). Plaintiffs three remaining motions (Doc. Nos. #3 , #4 , and #5 ) are reserved for the receiving Court. Signed by District Judge William L. Campbell, Jr on 7/9/2019.
