Queener 3:16-cv-3314 docket entry 33 at page 4 where the court held "The district court properly held that, as a United States citizen residing in Bermuda, Smith could not establish diversity jurisdiction. For diversity jurisdiction to apply under 28 U.S.C. 1332(a)(3), the suit must be between citizens of different states, and the amount in controversy must exceed $75,000. In order to be a citizen of a State within the meaning of the diversity statute, a natural person must both be a citizen of the United States and be domiciled within the State. Newman-Green, Inc. v. Alfonzo-Larrain, 490 U.S. 826, 828 (1989). [D]omicile is established by physical presence in a place in connection with a certain state of mind concerning ones intent to remain there. Miss. Band of Choctaw Indians v. Holyfield, 490 U.S. 30, 48 (1989)." The court questions if it has jurisdiction over this case and why I should not recommend this matter be sent back to state court.
