ORDER: Because it appears from Plaintiff's submissions that she lacks sufficient financial resources from which to pay the full filing fee in advance, the Court GRANTS her motion (Doc. No. #2 ) to proceed IFP in this matter. Katherine Holmes is hereby ASSESSED a $350 filing fee. For the reasons stated in the accompanying Memorandum Opinion, the Court finds that Plaintiff has stated a claim against Defendant Bronson in his individual capacity for violation of her Eighth Amendment rights under the United States Constitution. All other Defendants and claims are DISMISSED without prejudice. The Clerk is INSTRUCTED to send Plaintiff a service packet (a blank summons and USM 285 form) for Defendant Bronson. Plaintiff MUST complete the service packet for Defendant Bronson and return it to the Clerk's Office within 28 days of the date of this Order. Upon return of the completed service packet, PROCESS SHALL ISSUE. Plaintiff's motion for appointment of counsel #3 is DENIED without prejudice to her ability to seek counsel later if circumstances warrant. This action is REFERRED to the Magistrate Judge to enter a scheduling order for the management of the case, to dispose or recommend disposition of any pretrial motions under 28 U.S.C. 636(b)(1)(A) and (B), and to conduct further proceedings, if necessary, under Rule 72(b) of the Federal Rules of Civil Procedure and the Local Rules of Court.
