December 20, 2019 Opinion or Order Filing 10 AMENDED ORDER: Michael Joseph Blondin, a state inmate confined in the Bledsoe County Correctional Complex in Pikeville, Tennessee. The matter is before the Court for a ruling on Plaintiffs IFP application. (Doc. No. #2 .) Because it appears from Plaintiff's submissions that he lacks sufficient financial resources from which to pay the full filing fee in advance, the Court GRANTS his motion (Doc. No. #2 ) to proceed IFP in this matter. Plaintiff is hereby ASSESSED a $350 filing fee. The Clerk of Court is DIRECTED to send a copy of this Order to the Warden of the Bledsoe County Correctional Complex to ensure that the custodian of Plaintiff's inmate trust account complies with the portion of 28 U.S.C. 1915 pertaining to payment of the filing fee. This action is thus DISMISSED in its entirety. This is the final Order denying all relief in this matter. The Clerk SHALL enter judgment. Fed. R. Civ. P. 58(b). December 2, 2019 Opinion or Order Filing 6 ORDER DISMISSING CASE: Michael Joseph Blondin, a state inmate confined in the Bledsoe County Correctional Complex in Pikeville, Tennessee, filed a pro se complaint for alleged violation of his civil rights pursuant to 42 U.S.C. 1983 and an application to proceed in forma pauperis (IFP). The matter is before the Court for a ruling on Plaintiff's IFP application. (Doc. No. #2 .) Because it appears from Plaintiff's submissions that he lacks sufficient financial resources from which to pay the full filing fee in advance, the Court GRANTS his motion (Doc. No. #2 ) to proceed IFP in this matter. Accordingly, Plaintiff is hereby ASSESSED a $350 filing fee. The Clerk of Court is DIRECTED to send a copy of this Order to the Warden of the Bledsoe County Correctional Complex. For the reasons set forth in the accompanying Memorandum Opinion #5 , the Court concludes that Plaintiff fails to state a claim for which relief can be granted with respect to his federal claims, and on that basis those claims are DISMISSED with prejudice as to Defendant Bedford County Public Defender's Office and DISMISSED without prejudice as to the other Defendants. 28 U.S.C. 1915(e)(2)(B) and 1915A. This action is thus DISMISSED in its entirety. This is the final Order denying all relief in this matter. The Clerk SHALL enter judgment. Fed. R. Civ. P. 58(b).
