April 7, 2021 Opinion or Order Filing 56 MEMORANDUM OPINION AND ORDER: Young brings state law claims against B&D for strict liability, negligence and violations of the Tennessee Consumer Protection Act, and requests both compensatory and punitive damages. B&D has filed a "Motion to Dismiss for Failure to State a Claim Upon Which Relief can be Granted or in the Alternative for Judgment on the Pleadings" (Doc. No. 48 ) seeking dismissal of the TCPA claim and the request for punitive damages. On the basis of the foregoing, B&D's "Motion to Dismiss for Failure to State a Claim Upon Which Relief can be Granted or in the Alternative for Judgment on the Pleadings" (Doc. No. 48 ) is DENIED.
