Filing 4 ORDER: Plaintiff Black Swag Trust, SPC ("Black Swag") has filed a civil complaint seeking over one billion dollars in damages from defendant Core Civic. (Doc. No. #1 .) The court is concerned that Mwana and Avery are the same Tennessee Department of Correction ("TDOC") inmate and that this individual may be the actual party-in-interest in this case. The court takes judicial notice of records in a prior federal court action brought by David Anthony Avery a/k/a Azizi Mwana. The court will give the plaintiff an opportunity to address these concerns. If Black Swag wishes to continue this action as a corporate entity, it MUST (1) enter an appearance by counsel and (2) submit the full $400.00 civil filing fee to the Clerk of Court. If, instead, Azizi Mwana/David Anthony Avery wishes to pursue this action pro se as an individual, he may (1) file an amended complaint listing himself as the plaintiff and stating his individual claims, and (2) pay the full $400.00 civil filing fee or submit an application to proceed as a pauper. Finally, based on the filings to date, the Clerk SHALL modify the docket to reflect the plaintiff's address to be the return address on the envelope that contained the complaint. (Doc. No. #1 at 16.)
