Filing 5 ORDER: Plaintiff's application to proceed as a pauper #2 is GRANTED, and he is ASSESSED the $350.00 filing fee, to be paid as follows: The custodian of Plaintiff's inmate trust account is DIRECTED to submit to the Clerk of Court, as an initial payment, "20 percent of the greater of(A) the average monthly deposits to [Plaintiff's] account; or (B) the average monthly balance in [Plaintiff's] account for the 6-month period immediately preceding the filing of the complaint." 28 U.S.C. 1915(b)(1). After the initial filing fee is fully paid, the trust account officer must withdraw from Plaintiff's account and pay to the Clerk monthly payments equal to 20% of all deposits credited to Plaintiff's account during the preceding month, but only when the amount in the account exceeds $10. These payments must continue until the $350.00 filing fee is paid in full. Id. 1915(b)(2). The Clerk is DIRECTED to send a copy of this Order to the Metro-Davidson County Detention Facility to ensure that the custodian of Plaintiff's inmate trust account complies with the portion of 28 U.S.C. 1915 pertaining to payment of the filing fee. Plaintiff's request for release from custody is DENIED without prejudice, and Plaintiff fails to state a claim under Section 1983 at this time. Nonetheless, the Court GRANTS Plaintiff an opportunity to file an Amended Complaint in light of the standards discussed in the Memorandum. For this purpose, the Clerk is DIRECTED to mail Plaintiff a blank Complaint for Violation of Civil Rights (Prisoner) (AO Form Number Pro Se 14). Plaintiff must file any Amended Complaint using this form within 30 DAYS of the date this Order is entered on the docket, and it must include the assigned case number, No. 3:20-cv-00798. Plaintiff may attach additional pages to the form complaint, if necessary. Failure to file an Amended Complaint within the allotted time will result in dismissal of this action. Plaintiff also must keep the Court informed of his current address at all times. Signed by District Judge William L. Campbell, Jr on 9/30/2020.
