ORDER: On October 21, 2020, James Hundley, proceeding pro se, filed a Motion to Confirm Arbitration Award (Doc. No. #1 ). Mr. Hunley paid the $47.00 miscellaneous filing fee and insists that a civil case does not need to be filed, with the attendant $400.00 filing fee, even though the Clerk has informed him that his motion must be assigned a civil case number and he must pay the $400.00 filing fee. The Clerk is correct. the Clerk shall return Mr. Hundley's $47.00 filing fee. If he intends to pursue this action, he shall either pay the requisite $400.00 filing fee or submit an application to proceed in forma pauperis within thirty (30) days of the date of this Order. Mr. Hundley is cautioned that failure to comply with this Order will result in dismissal of this action for failure to prosecute. Signed by District Judge Aleta A. Trauger on 10/29/2020.
