Date Filed Document Text
January 4, 2021 Opinion or Order Filing 8 ORDER: [T]he Court ordered Petitioner to file an amended petition to facilitate orderly review of his claims. (Doc. No. #4 .) Petitioner seeks an extension of time to file the required amended petition. (Doc. Nos. #6 , #7 .) The request for additional time is GRANTED, and Petitioner's deadline to file his amended petition is extended to 30 days from entry of this Order. Petitioner also asserts that he previously filed his only copies of documents he needs in order to prepare his amended petition. (Doc. No. #7 at 1.) He asks the Court to return those documents. (Id.) That request is also GRANTED, and the Clerk of Court is INSTRUCTED to furnish Petitioner with a copy of Docket Entry No. #1 , including all attached documents. Petitioner also asks for copies of the Habeas Rules and the local rules of this Court. (Doc. No. #6 at 5.) Accordingly, that request is DENIED without prejudice. Accordingly, the Clerk is DIRECTED to substitute Warden Kevin Genovese as the Respondent in this case. Signed by District Judge William L. Campbell, Jr on 1/4/2021. November 23, 2020 Opinion or Order Filing 4 ORDER: Because Petitioner's IFP application establishes that he lacks sufficient funds to pay the filing fee in this case, the application (Doc. No. 2) is GRANTED. Petitioner's claims are currently scattered incoherently throughout 354 pages of a form petition and attachments in such a fashion that they are difficult to read and even more difficult to decipher. To cure this deficiency, Petitioner must resubmit his grounds for relief in a single amended petition in order to facilitate their orderly review. The Clerk is DIRECTED to send Petitioner a new blank form Petition Under 29 U.S.C. 2254 For Writ of Habeas Corpus By A Person In State Custody (http://www.tnmd.uscourts.gov/files/relief_petition.pdf). Accordingly, the Clerk is DIRECTED to substitute Warden James Holloway as the only Respondent in this case. Signed by District Judge William L. Campbell, Jr on 11/23/2020. (xc:Pro se party by regular mail along with a new blank form Petition Under 29 U.S.C. 2254 For Writ of Habeas Corpus By A Person In State Custody.)
