ORDER: Before the Court is Petitioner's Motion to Vacate his sentence (Doc. No. 1) in criminal case number 3:16-cr-00077-1. Pursuant to Rule 4 of the Rules Governing Section 2255 Cases in the United States District Courts (the "2255 Rules) the Court has initially reviewed the petition and it does not plainly appear" that Petitioner is not entitled to relief. Pursuant to 18 U.S.C. 3006A(a)(2)(B), the Court finds that the interests of justice require counsel be appointed for Petitioner.
