MEMORANDUM AND ORDER: Pending before the Court is Plaintiffs' motion to strike affirmative defense (Docket No. #9 ), to which Defendant filed a response in opposition (Docket No. #13 ) and Plaintiffs filed a subsequent reply (Docket No. #14 ). Because Tenn. Code Ann. 20-1-119 has no legal effect under these circumstances and given the clear directive that striking defenses is an extraordinary action under Rule 12(f), the motion to strike (Docket No. #9 ) is denied without prejudice.
