ORDER: No later than Wednesday, 8/11/2021, Plaintiff SHALL file either: 1) an amended complaint, or 2) a response to Defendants' pending Motion to Strike and Motion to Dismiss. If Plaintiff files an amended complaint, that complaint will become the legally operative complaint and will moot Defendant's Motion to Dismiss. Defendants may then refile a Motion to Dismiss that is responsive to the amended complaint. If Plaintiff instead files a response to Defendants' pending motions, Defendants may file a reply no later than 8/18/2021. The Court will also reserve judgment on Defendants' Motion to Strike until it has the benefit of briefing by each party.
