Filing 4 ORDER: Joshua Lee Brown, an inmate at Trousdale Turner Correctional Center in Hartsville, Tennessee, has a pro se civil rights action under 42 U.S.C. 1983 already pending in this Court regarding the alleged denial of medical care for Brown's jaw following a fight. See Brown v. Med. Staff at Core Civic, No. 3:21-cv-00527. In that case, the Court ordered Brown to file an Amended Complaint on or before August 17, 2021. Id., Doc. No. 10 (M.D. Tenn. July 15, 2021). On July 27, the Court received a civil rights complaint from Brown including a similar allegation. (Doc. No. #1 .) This initiated the opening of a new case. However, it is apparent that Brown intended the filing received on July 27 to serve as the Amended Complaint in his pre-existing civil rights action. Accordingly, the Clerk is DIRECTED to file Doc. No. #1 as an "Amended Complaint" in Case No. 3:21-cv-00527, and then ADMINISTRATIVELY CLOSE this case. No filing fee, or "strike" under the Prison Litigation Reform Act, is assessed as to this case. Brown is reminded that, for all filings related to his pre-existing civil rights action, he MUST include the proper case number, No. 3:21-cv-00527. Signed by District Judge Eli J. Richardson on 8/6/2021. (xc:Pro se party by regular mail. ) (DOCKET TEXT SUMMARY ONLY-ATTORNEYS MUST OPEN THE PDF AND READ THE ORDER.)(vh) |
