Filing 12 ORDER: Plaintiff Frederick D. Martin is hereby assessed the full filing fee of $350, his application (Doc. No. #4 ) is hereby GRANTED. The Clerk of Court is DIRECTED send a copy of this order to the administrator of inmate trust fund accounts at the TTCC. Having conducted the screening required by the PLRA, the Court determines that the complaint states an Eighth Amendment excessive force claim under 42 U.S.C. 1983 against Lieutenant Hill in his individual capacity. Further, the complaint states a First Amendment retaliation claim against Lieutenant Hill in his individual capacity. These claims shall proceed for further development of the record.All other claims and Defendants are DISMISSED for the reasons stated in the accompanying Memorandum Opinion. Consequently, the Clerk is DIRECTED to send Plaintiff a service packet (a blank summons and USM 285 form) for Lieutenant Hill. The Clerk also shall send the Plaintiff the Court's Information Sheet for pro se prisoners entitled "Service of Process in Civil Rights Cases." Plaintiff MUST complete the service packet and return it to the Clerks Office no later than 30 days after entry of this Order. Upon return of the service packet, PROCESS SHALL ISSUE to Defendant. This action is REFERRED to the Magistrate Judge to enter a scheduling order for the management of the case, to dispose or recommend disposition of any pre-trial, non-dispositive motions, to issue a Report and Recommendation on all dispositive motions, and to conduct further proceedings, if necessary, under Rule 72(b), Fed.
