Filing 13 ORDER: The Court hereby REVISES its non-final Order of January 19, 2022 to permit failure to protect/intervene claims under Section 1983 to proceed against Defendant Mallard in his/her individual capacity and against CoreCivic. The Clerk is DIRECTED to send Plaintiff a service packet (a blank summons and USM 285 form) for the remaining Defendants: Atkins, Gunter, Burlisky, Tatum, Mallard, CoreCivic, Mase, Austin, Franks, Beckum, Coleman, Sarratt, and Griffton. Plaintiff MUST complete the service packets and return them to the Clerk's Office no later than 30 days after entry of this Order. Upon return of the service packets, PROCESS SHALL ISSUE to Defendant The Clerk also is DIRECTED to send the Plaintiff the Court's Information Sheet for pro se prisoners entitled Service of Process in Civil Rights Cases." This action is REFERRED to the Magistrate Judge to enter a scheduling order for the management of the case, to dispose or recommend disposition of any pre-trial, non-dispositive motions, to issue a Report and Recommendation on all dispositive motions, and to conduct further proceedings, if necessary, under Rule 72(b), Fed. Filing 7 ORDER: From a review of Plaintiff's application, it appears that he lacks sufficient financial resources from which to pay the full filing fee in advance. Therefore, his application (Doc. No. #2 ) is GRANTED. Assessing Filing Fee for Jerome Perkins. The Clerk of Court is DIRECTED send a copy of this Order to the administrator of inmate trust fund accounts at the South Central Correctional Facility to ensure that the custodian ofPlaintiffs inmate trust account complies with that portion of 28 U.S.C. 1915 pertaining to thepayment of the filing fee. The Court has reviewed the complaint pursuant as required by the Prison Litigation ReformAct and, for the reasons set forth in the Memorandum entered contemporaneously with this Order, finds that the complaint states colorable failure to protect claims under 42 U.S.C. 1983 against Defendants Atkins, Gunter, Burlisky, and Tatum in their individual capacities. These claims shall proceed for further development. With respect to all other claims and Defendants, the complaint fails to state claims upon which relief can be granted under Section 1983. Accordingly, those claims and Defendants not specifically enumerated above are hereby DISMISSED. Plaintiff shall be permitted to file an amended complaint. If Plaintiff elects to amend his complaint, he MUST do so within 30 days of entry of this Order. Finally, the Clerk is DIRECTED to remove Trousdale Turner Core Civic, f/n/u Grossman, f/n/u Gross, f/n/u Holmes, and f/n/u Lestor as Defendants to this action, for the reasons discussed in the accompanying Memorandum Opinion.
