Filing 9 ORDER: Petitioner Michael Bailey, an inmate of the Riverbend Maximum Security Institution in Nashville, Tennessee, has filed a pro se petition for writ of habeas corpus pursuant to 28 U.S.C. 2254 (Doc. No. #1 ) and a Motion for Writ of Mandamus (Doc. No. #6 ). Petitioner also has filed an Application to Proceed In Forma Pauperis and supporting documents. (See Doc. Nos. #2 , #8 ). Based on the documentation provided, Petitioner had sufficient funds on December 1, 2021 to pay the $5.00 filing fee for habeas actions. However, Petitioner's financial circumstances may have changed since December 1, 2021, such that Petitioner no longer has sufficient funds with which to pay the $5.00 filing fee. In summary, to proceed Petitioner MUST 1) submit the habeas filing fee of $5.00 or 2) obtain and submit a more recent certified statement showing his account balance as of the date of submission, if the account balance shows that Petitioner lacks sufficient funds to pay the $5.00 filing fee. Petitioner may request an extension of time to comply with this Order if he does so in writing within 30 days of the date this Order was entered. Signed by District Judge William L. Filing 5 ORDER: Michael Bailey, an inmate of the Riverbend Maximum Security Institution in Nashville, Tennessee, has filed a pro se petition for writ of habeas corpus pursuant to 28 U.S.C. 2254. (Doc. No. #1 ). The Court cannot process the petition at this time. In order to file a civil lawsuit, a petitioner must submit the civil filing fee or an application to proceed in forma pauperis. The Clerk is DIRECTED to mail Petitioner a blank application to proceed in forma pauperis for prisoners. Petitioner, in turn, is DIRECTED to do one of the following within 30 days of the date he receives this Order: either return to the district court a completed application to proceed in forma pauperis or submit the full civil filing fee of five dollars ($5.00) to the Clerk of Court.
