ORDER: Pending before the Court is Respondent's Motion for Order Deeming Attorney-Client Privilege Waived. (Doc. No. #9 ). Through the Motion, Respondent submits that it needs to interview Petitioner's former attorney, Patrick McNally, in order to adequately to Petitioner's claims of ineffective assistance of counsel. The Motion is GRANTED. Respondent is permitted to interview Mr. McNally, but only to the extent necessary to respond adequately to Petitioner's claim of ineffective assistance of counsel.
