MEMORANDUM OPINION AND ORDER OF THE COURT: The plaintiff's IFP application #2 is GRANTED. His motion to amend #4 is DENIED. This action is DISMISSED pursuant to 28 U.S.C. 1915(e)(2)(B)(ii), for failure to state a claim on which relief may be granted. The dismissal is without prejudice to the plaintiff's ability to pursue relief in state court. In light of this dismissal, the plaintiff's motion to appoint counsel #5 is DENIED as moot.
