ORDER DISMISSING CASE: On September 22, 2022, the defendant filed a Motion to Compel Arbitration and Dismiss Case Without Prejudice (Doc. No. #7 ), to which no timely response has been filed. Local Rule 7.01(a)(3) provides, in part, as follows: "If a timely response is not filed, the motion shall be deemed to be unopposed,...." The defendant's motion is well grounded, has merit, and is deemed unopposed. Therefore, the motion is GRANTED, and this case is DISMISSED WITHOUT PREJUDICE.
