For the reasons explained in the Court's previous Memorandum Opinion and Order (see Doc. No. #6 at 2-5), the Court determines that an appeal would not be taken in good faith. It is therefore CERTIFIED, pursuant to Fed. R. App. P. 24(a), that any appeal in this matter would not be taken in good faith. Hessmer's Application for Leave to Proceed In Forma Pauperis on appeal (Doc. No. #8 ), therefore, is DENIED. To proceed, Petitioner must pay the full $505 appellate filing fee or file a motion to proceed in forma pauperis, along with a supporting affidavit, in the United States Court of Appeals for the Sixth Circuit within 30 days.
