ORDER: In 2002, a state jury convicted Garner Dwight Padgett of first-degree murder, and the trial court sentenced him to life imprisonment. In re: Garner Padgett, No. 21-6235, Doc. No. 21-2 at 1 (6th Cir. June 17, 2022). Since then, Padgett has unsuccessfully attempted to challenge this judgment on direct appeal, through the state post-conviction process, and through the federal habeas corpus process. [F]or this case to proceed, Padgett MUST follow the instructions below to clarify the nature of this case and resolve the filing fee. Padgett MUST file a written response to this Order clarifying if he is bringing this case under Section 1983, Section 2254, or some other statute. To proceed under Section 1983, Padgett also MUST either pay the full $402 filing fee in one lump sum or submit an application to proceed as a pauper. Alternatively, to proceed under Section 2254, Padgett also MUST either pay the $5 filing fee or submit an application to proceed as a pauper. The Clerk is DIRECTED to mail Padgett a blank application to proceed as a pauper for prisoners (short form). Signed by District Judge Eli J. Richardson on 11/30/2022.
