June 6, 2023 Opinion or Order Filing 5 ORDER: On April 20, 2023, the court concluded that the complaint failed to satisfy Federal Rule of Civil Procedure 8(a) because the plaintiff failed to "provide an adequate factual basis for [his] Title VII discrimination or retaliation claims." (Doc. No. #4 .) The court ordered the plaintiff to submit an amended complaint that complied with Rule 8(a) within thirty days or face "dismissal without further order." Id. The plaintiff, however, has not responded to this order, or otherwise communicated with the court, by the deadline. Thus, this action is DISMISSED WITHOUT PREJUDICE for failure to comply with the Federal Rules and want of prosecution. Fed. R. Civ. P. 8; Fed. R. Civ. P. 41(b); Carpenter v. City of Flint, 723 F.3d 700, 704 (6th Cir. 2013); Link v. Wabash R.R., 370 U.S. 626, 630 (1962). This form of dismissal allows the plaintiff to bring a new civil action regarding these or other matters, subject to all applicable rules and time limits. It is so ORDERED. April 20, 2023 Opinion or Order Filing 4 ORDER: Dashon Hines, a pro se New York resident, filed a complaint against Sandy Garrett under Title VII of the Civil Rights Act of 1964 ("Title VII"). (Doc. No. #1 .) The plaintiff also filed an application to proceed in forma pauperis that demonstrates he cannot pay the full civil filing fee in advance without "undue hardship." The application (Doc. No. #2 ) is therefore GRANTED. At this stage, the complaint does not provide an adequate factual basis for the plaintiff's Title VII discrimination or retaliation claims.
