Filing 9 ENTRY OF JUDGMENT re: #8 Order Dismissing Case, #7 Memorandum Opinion of the Court (xc:Pro se party by regular mail.) (mg) |
Filing 8 ORDER DISMISSING CASE: Cornelius D. Pierce, an inmate at the Downtown Detention Center, filed a pro se civil rights complaint under 42 U.S.C. 1983, an application to proceed as a pauper (Doc. No. #2 ), and three letters clarifying the complaint. (Doc. Nos. #4 , #5 , #6 .) The clarifying letter docketed as a motion (Doc. No. #4 ) is GRANTED. And for the reasons stated in the accompanying memorandum #7 , the court rules as follows: The plaintiff's application to proceed as a pauper (Doc. No. #2 ) is GRANTED and he is ASSESSED the $350.00 filing fee. The Clerk is DIRECTED to send a copy of this order to the Downtown Detention Center. Upon initial review, this case is DISMISSED for failure to state a claim, 28 U.S.C. 1915A, and the court CERTIFIES that an appeal in this matter would not be taken in good faith. 28 U.S.C. 1915(a)(3). So this court will not grant the plaintiff leave to proceed as a pauper on any appeal. This is the final order denying all relief in this case. The Clerk SHALL enter judgment. Signed by District Judge Aleta A. Trauger on 10/23/2023. (xc:Pro se party by regular mail along with a copy of this Order to the Downtown Detention Center.)
