December 20, 2023 Opinion or Order Filing 6 ORDER DISMISSING CASE: By Order entered on August 23, 2023, the Court notified Plaintiff that this action could not proceed until he took further action. (Doc. No. #5 ). Specifically, Plaintiff had not submitted the required certified account statement along with his Application for Leave to Proceed In Forma Pauperis. The Court instructed Plaintiff to submit the missing statement or the full filing fee within 30 days; otherwise, the Court warned that this action could be dismissed. Accordingly, this action is hereby DISMISSED for failure to comply with the Order of the Court and for want of prosecution. Fed. R. Civ. P. 41(b). Plaintiff's Application for Leave to Proceed In Forma Pauperis (Doc. No. #2 ) is DENIED AS MOOT. Because an appeal would not be taken in good faith, Plaintiff is not certified to pursue an appeal from this judgment in forma pauperis. 28 U.S.C. 1915(a)(3). (Doc. No. #1 ). Plaintiff also filed an Application for Leave for Proceed In Forma Pauperis. (Doc. No. #2 ). Plaintiff's Application, however, is incomplete. To proceed as a pauper, Plaintiff MUST submit the required certified statement within 30 days of entry of this Order. The required certified statement need not be notarized.
