Witherspoon is ORDERED to execute an assignment of rights to the ULE in order to evidence MESSCOs sol e ownership of the ULE. This assignment is to be executed within thirty (30) days from the issuance of this Order. Defendant David Moneyhun is to be terminated from the case because the remaining claims contained within the Second Amended Complaint a re directed against solely against Defendant MESSCO. The Parties are FURTHER ORDERED to meet and confer and submit to the Court within thirty (30) days from the issuance of this Order a Proposed Amended Scheduling Order that will govern the remainder of the case going forward.
