MEMORANDUM DECISION and Ordergranting in part and denying in part 8 Motion to Dismiss. The court DENIES Defendants motion to dismiss Plaintiffs first claim for relief under the Utah Area Assessment Area Act, Utah Code Ann. 11-42-10 1 et seq. Because this courts ruling is dispositive on these claims, it GRANTS the motion to dismiss all claims in the alternative. Additionally, because the courts ruling will likely determine the overall outcome of this dispute, the court will entertain motions for judgement based on the pleadings.
