MEMORANDUM DECISION AND ORDER-Based on the foregoing, the court concludes that all of Plaintiffs claims are preempted by ERISA. Consequently, Defendants motion to dismiss is GRANTED, and Plaintiffs request for attorney fees and costs is DENIED.
