Filing 46 MEMORANDUM DECISION and Order: For the reasons stated in this Order, the court GRANTS IN PART and DENIES IN PART the cross-motions for summary judgment. This court holds that while Utah Code §76-10-1313(2) is unconstitutionally vague, the remainder of the statute passes constitutional scrutiny.
