Minute Entry for proceedings held before Magistrate Judge Dustin B. Pead: Supplemental Proceedings Hearing held on 6/28/2016. Counsel present for parties. Witness sworn in and provides testimony outside presence of the court. The parties reached an impasse on three issues. The court heard argument on the record and made rulings. The first issue regarding the attorney-client privilege was resolved on the record and testimony provided in accordance with court's ruling. Second, the parties disagreed about the relevant time frame for which financial records should be produced. The court ordered Defendant to provide all bank records in Defendant's possession for two discrete time frames: June 2015 until June 2016; and from January 2011 until November 2011. These records must be provided no later than July 22, 2016. Finally, Plaintiff requested a continuance of the supplemental proceedings based on the witness' lack of knowledge regarding certain transactions. Defendant suggested that another witness, Ms. Patricia Weldon, could discuss these transactions, but was unavailable for the supplemental proceedings. Defendant's counsel advised court that he attempted to contact Plaintiff's counsel via email about Ms. Weldon's unavailability, but did not receive any response. The court denied the motion for continuance without prejudice and further ordered that Defendant must make Ms. Weldon available by telephone no later than August 5, 2016, but only after Defendant produces the bank records described above. If the telephone conversation with Ms. Weldon does not provide Plaintiff with the information it needs, Plaintiff may renew the motion for a continuance, but must do so within fourteen days of the conversation with Ms. Weldon.
