MEMORANDUM DECISION and ORDER granting in part and denying in part 55 Motion for Summary Judgment. The Court GRANTS Summary Judgment on all claims in favor of all Defendants with prejudice, with the exception of two claims. The Court DENIES Summary Judgment for UPD on the § 1983 municipal liability claim, and this Court certifies a question to the Utah Supreme Court regarding applicability of Utah Code section 18-1-1. The Court ORDERS the parties to meet and confer within fourteen days of this Order, and to submit either joint or separate proposed questions for certification within thirty days of this Order.
